Terms of service statement VoIP has differences from traditional telephony. USA-Connect VoIP service, including 911 dialing, will not work if the Internet is down, during power outages or in other unique situations. Customer 911 calls, made from areas other than the registered address, may not route directly to a 911 operator. Customers should secure alternative access to 911 services for emergencies or mission critical applications. VoIP should not be used behind a firewall. Internal firewalls, internal cabling, and customer equipment are the responsibility of the customer. Customers with service agreements with New York Connect are obviously exempt from this responsibility. VoIP will not function during power failures, Internet outages, suspension for billing issues, or outages for any reason including failure of your internal network. You will not be able to make or receive any calls including 911 calls. You may have to reboot equipment to become operational. If you are not in the Metro New York area, you may not be directly routed to a 911 operator. They may not receive your caller ID and may not be able to call back if your call is dropped. If you move without notifying us the 911 operator will have an incorrect address and may send emergency services to the wrong location. You should have a POTS (plain old telephone service) line as an emergency back up line. USA-Connect provides service on a best efforts basis and makes no promises as to VoIP availability. You acknowledge and understand that USA-Connect's liability is limited for any service outage and/or inability to dial emergency services from your line or to access emergency service personnel. In no event will New York Connect or USA-Connect be liable for any loss or damage of any kind including lost profits for any reason. You are limited to credits ONLY for time the service is unavailable when the outage is for more than four hours. MRCs (monthly recurring charges) are for the month forward and billable usage is for the past month. You must provide USA-Connect with a valid credit card number when the service is activated. If the credit card expires, changes or is closed for any reason you must advise USA-Connect immediately. Accounts not paid within thirty (30) days will be considered past due. Accounts not paid within thirty (30) days may be shut off until payment is received. There will be a $35 reconnection fee PER SERVICE. All cancellations must be in writing (fax, letter, e-mail) at least 30 days prior to the requested cancellation date. In no cases will we issue credits for cancellation prior to the date the notification is received. In the event of a service outage or problem, e-mail Support@NYCT.net or call 212 293 2620 and ask for support or phone support. Provide as much detail as possible including when the problem started, exact symptoms, patterns of problems, etc. In the event of an outage or changes to your setup you may need to reboot your equipment. To do this simply unplug the device power supply for ten seconds and plug it in again. Our staff will provide support but the user may be able to avoid the need for contacting support. The New York Connect and USA-Connect Network and Services must be used in a manner that is consistent with their intended purpose and may be used only for lawful purposes. Users may not use our Network and Services in a manner that may adversely affect the network and services or other New York Connect or USA-Connect customers or that may expose us to criminal or civil liability. We prohibit the use of auto dialers, call center activity, or web servers unless specifically approved. If numbers are being ported it can take up to a month to complete the process assuming there are no problems. Problems can include unknown existing contracts, Centrex conversion issues, delays from the current carrier, etc. Additionally there may be extra costs involved with breaking contracts. These costs are from the current carrier and are not from New York Connect or USA-Connect. This is for residential use ONLY. We reserve the right to suspend service at anytime for any reason. |
